IMPORTANT – ASSUMPTION OF RISK, RELEASE OF LIABILITY & WAIVER

Waiver & Release

By creating an account, offering a ride, requesting a ride, or participating in any ride through the FellaRide platform, you acknowledge, understand, and agree to the following:

A. Assumption of Risk

You acknowledge that carpooling and motor vehicle travel involve inherent risks, including but not limited to:

Traffic collisions
Serious bodily injury
Permanent disability
Death
Property damage
Criminal or negligent acts of third parties

You voluntarily and knowingly assume all such risks, whether caused by:

A Driver (Host)
A Passenger (Guest)
Another road user
Vehicle condition
Weather, road, or traffic conditions

B. Platform Role Acknowledgment

You understand and agree that:

FellaRide does not provide transportation services
FellaRide does not own, operate, or control vehicles
FellaRide does not employ or supervise Drivers (Hosts)
Each ride is a private arrangement between Users, including Drivers (Hosts) and Passengers (Guests)

C. Release of Liability

To the maximum extent permitted by applicable Canadian law, you hereby release, waive, and forever discharge:

Redefine Technologies Inc. (operating as FellaRide), including its directors, officers, employees, contractors, and agents,

from any and all claims, demands, damages, losses, costs, or liabilities, including those arising from:

Personal injury or death
Vehicle accidents or collisions
Property damage
Theft or loss of belongings
Acts or omissions of Drivers (Hosts) or Passengers (Guests)
Ride cancellations, delays, or route changes

INCLUDING claims arising from ordinary negligence, except where such exclusion is prohibited by law.

D. No Liability for Insurance Gaps

You expressly acknowledge and agree that:

FellaRide does not verify insurance coverage
A Driver’s (Host’s) insurance may be invalid, insufficient, or denied
FellaRide has no responsibility to provide insurance or compensation

E. Covenant Not to Sue

You agree that you will not bring any legal action against FellaRide for any injury, loss, or damage arising from a ride, except where prohibited by law.

F. Survival

This waiver and release:

Survives account termination
Applies to all past, present, and future rides

INSURANCE DISCLOSURE – READ CAREFULLY

Important Insurance Notice

FellaRide does NOT provide insurance of any kind.

You acknowledge and agree that:

Drivers (Hosts) are solely responsible for maintaining legally required automobile insurance.
Many personal auto insurance policies in Canada DO NOT cover carpooling, cost-sharing, or passenger transport.
Insurance coverage may be denied in the event of:
A collision
Injury
Property damage

FellaRide does not verify whether a Driver’s (Host’s) insurance:

Is valid
Covers passengers (Guests)
Covers carpooling activities

Driver (Host) Acknowledgment

If you are a Driver (Host), you confirm that:

You have personally confirmed with your insurer that carpooling is permitted
You accept full responsibility for any insurance denial or insufficiency
You will indemnify FellaRide for any claims arising from insurance issues

Passenger (Guest) Acknowledgment

If you are a Passenger (Guest), you confirm that:

You understand a Driver’s (Host’s) insurance may not cover you
You accept the risk of limited or no insurance protection
You agree that any claims must be directed to the Driver (Host) or their insurer
